    Workplace safety

    The Occupational Safety and Health Review Commission has partly vacated citations against a crane and rigging operator over radius hazards.

    In February 2020, a compliance safety and health officer for the U.S. Occupational Safety and Health Administration conducted a programmed inspection of North American Crane & Rigging LLC, resulting in citations issued for its alleged failure to adequately protect employees from the swing radii of two cranes at a construction site in Plainville, Massachusetts, according to documents in Secretary of Labor v. North American Crane & Rigging LLC.

    The citation alleged NACR failed in two instances to prevent exposure of its employees to swing radius hazards posed by two cranes “because it did not adequately mark the boundaries of the hazardous areas,” according to the 28-page ruling. NACR contested the citation, arguing the Secretary of Labor failed to prove its case. In its amended answer, NACR also asserted the affirmative defenses of greater hazard and infeasibility of compliance with the cited standard, according to the documents.

    In its decision, released Monday, the commission affirmed NACR’s basis for appeal, citing “the Secretary failed to establish NACR’s employees had actual access to the zone of danger in question, or that access was reasonably foreseeable based on the employees’ assigned work activities, personal comfort activities, or ingress/egress routes.” The commission further found the Secretary had not proved the element of employee access with regard to the right side of one crane in question.
